It is heartening to hear that Tommy Thomas is appointed as the new attorney general.
The preference for a Malay or Muslim attorney general is a weak convention. This convention could be not be strengthened further because the existing law in relation to the selection of the attorney general does not have this preference.
It is difficult to choose a new attorney general, what more when he is not a Malay or Muslim. The present Pakatan Harapan government discussed this issue thoroughly and it knows the implications. Thus, the decision was not made at the spur of the moment.
The new attorney general has vast knowledge in constitutional law. With this, he is the best person to strengthen further the institution of the Malay Rulers, Islam, and the ordinary Malays.
Furthermore when the Malaysian Constitution is strengthened, the social contract follows suit.
The social contract is not a convention as it had been codified into our Constitution. For example, the institutions of the Malay Rulers, Islam and the Malay privileges are not mere conventions; they are codified laws appropriated from the social contract.
PH had sworn to uphold and defend the Constitution vis-à-vis the social contract.
