Proses lantikan ahli SPR baharu membelakangi manifesto dan semangat reformasi (Malay/English)

[ENGLISH VERSION BELOW] Gabungan Pilihan Raya Bersih dan Adil (BERSIH) menyatakan kekesalan terhadap lantikan ahli Suruhanjaya Pilihan Raya (SPR) yang terbaharu tanpa semakan Parlimen.

SPR melalui kiriman di laman Facebook mereka mengalu-alukan ahli SPR terbaharu iaitu Sapdin Ibrahim, yang telah memulakan tugas pada 6 Mei.

Perkembangan lantikan terbaharu SPR ini adalah sangat mengecewakan dan menunjukkan bahawa Perdana Menteri Anwar Ibrahim dan kerajaan “Madani” tidak serius untuk mereformasi SPR.

Kedua-dua Pakatan Harapan dan Barisan Nasional merupakan komponen terbesar di dalam kerajaan Madani kini.

Namun kedua-dua gabungan tersebut tidak menghormati manifesto yang mereka sendiri rangka, sekali gus memperkukuhkan persepsi bahawa kerajaan Madani tidak serius dalam usaha untuk mereformasikan institusi dan membawa budaya politik yang lebih progresif serta inklusif.

Bersih ingin mengingatkan bahawa kedua-dua PH dan BN menjanjikan untuk pelantikan jawatan-jawatan utama akan disemak melalui jawatankuasa khas parlimen.

Janji ke-15 bagi mengukuhkan integriti institusi di dalam buku Tawaran Harapan pilihan raya umum 2022 menyatakan bahawa jawatan utama seperti SPR, Suruhanjaya Pencegah Rasuah Malaysia dan ketua polis negara perlu disemak oleh Parlimen terlebih dahulu.

Janji yang sama juga dinyatakan di dalam dokumen perancangan amal dan usaha (Padu) BN, yang merupakan tema manifesto BN dalam pilihan raya umum 2022 yang lepas.

Dokumen tersebut menyatakan keperluan penubuhan jawatankuasa parlimen untuk mencadangkan dan menapis jawatan utama SPR, SPRM dan gabenor Bank Negara.

Kerajaan Madani hanya dapat menebus kegagalan ini dengan segera mengumumkan bahawa proses lantikan pengerusi SPR baharu selepas persaraan Ghani Salleh akan dilakukan melalui penubuhan jawatankuasa tetap parlimen hal ehwal pilihan raya.

Jawatankuasa tetap ini perlu merangkumi ahli-ahli parlimen yang dwipartisan, serta menetapkan proses dan kriteria yang jelas pelantikan pengerusi SPR yang baharu.

Kriteria seperti adil, berintegriti, mempunyai minda serta keazaman melaksanakan reformasi, tidak mempunyai keahlian parti politik atau pernah memegang jawatan utama dalam parti politik, berpengetahuan dalam perkara berkaitan pilihan raya serta tidak mempunyai rekod jenayah atau kesalahan pilihan raya yang serius perlu menjadi kriteria utama untuk jawatan seorang pengerusi SPR.

Sekiranya perkara tersebut tidak dilaksanakan, kerajaan Madani dan perdana menteri tidak lagi wajar menjaja perkataan reformasi yang setakat ini hanya seperti menanam tebu di tepi bibir sahaja. Rakyat akan terus mempersoalkan sejauh manakah iltizam reformasi yang dilaungkan. – Bersih

Appointment process of new Election Commission members contravenes manifesto and Reformasi spirit

The Coalition for Clean and Fair Elections (Bersih) expresses disappointment with the latest appointment of an election commissioner without parliamentary review.

The Election Commission, through a post on its Facebook page, welcomed its newest member, Sapdin Ibrahim, who began his duties on 6 May.

This latest development is very disappointing and shows that Prime Minister Anwar Ibrahim and the “unity government” are not serious about reforming the Election Commission.

Both Pakatan Harapan and Barisan Nasional are the largest components of the current “Madani” (civil and compassionate) government, but both coalitions are not respecting the manifesto they themselves drafted. This reinforces the perception that the Madani government is not serious about efforts to reform institutions and bring a more progressive and inclusive political culture.

Bersih wants to remind all that both PH and BN have promised that key appointments would be reviewed through a special parliamentary committee.

The 15th promise in Buku Harapan (Book of Hope), the manifesto for the 2022 general election, was to strengthen institutional integrity. It states that key positions such as to the Election Commission, the Malaysian Anti-Corruption Commission and for the inspector general of police need to be reviewed by Parliament first.

The same promise is also stated in the plan of action and effort (Padu) document from BN, which was the theme of BN’s manifesto for the 2022 general election. That document outlines the need to establish a parliamentary committee to recommend and screen key positions to the Election Commission, the Malaysian Anti-Corruption Commission and the governor of Bank Negara.

The Madani government can only make amends for this failure by immediately announcing that the process of appointing a new Election Commission chairman after the retirement of Ghani Salleh will be carried out through the establishment of a parliamentary standing committee on electoral affairs.

This standing committee should comprise bipartisan MPs and set clear processes and criteria for appointing a new Election Commission chairman.

Criteria such as fairness, integrity, a progressive mindset and determination to implement reforms are important. The candidate should not be a member of any political party and should not have held key positions in a political party. The candidate should also have knowledge of election-related matters and should have no record of criminal or serious electoral offences. These must be key criteria for the position of an Election Commission chairman.

If this is not implemented, the Madani government and the prime minister can no longer use the word reform, which so far has been nothing more than lip service. The public will continue to question the extent of its commitment to the reform that has been touted. – Bersih
