The Coalition for Clean and Fair Elections (Bersih 2.0) refers to Barisan Nasional candidate Mohamad Hasan’s action of flashing his ballot paper after marking it and before putting it into the ballot box yesterday at the Rantau by-election.
Does he not know that it is an election offence to breach the secrecy of a vote, even one’s own vote, or did he do it in defiance of the law?
Section 5 of the Election Offences Act 1954 underlines the importance of maintaining secrecy of voting and information related to voting. The penalty for breaching secrecy is up to one-year imprisonment or RM3,000 or both.
The reason why the secrecy of the ballot is important is exposure of how one voted on polling day, especially someone influential, after the campaign period is over, could influence how others vote. It could even facilitate the buying and selling of votes.
Such a breach by Mohamad, if not dealt with, might encourage others to flagrantly expose their votes in future elections. This could have serious consequences related to the offence of campaigning on polling day and corruption.
Bersih 2.0 calls on the police and the Electoral Commission to act against Mohamad for such a blatant and defiant act of breaking election laws. A strong message must be sent that secrecy must be maintained during voting and that no one is above the law.

This begs the question: had PH won, would it have been an offence?

Your say, folks 😘
It appears the govt does not have the political will to do what is best & right to build a united & harmonious Malaysia. Islam & the Malays were NEVER threatened by the minority. They were threatened only by their own dishonest tribe. The minority asks only to be given an opportunity to earn an honest living & do our own thing without inteference into our culture & lifestyle. We’ll continue to pay our income tax. Is this too much to ask for??
He should be hauled up by Macc & Probed for RM10 million where he got it & how?
Idiots act smart serve you right 😝😝🤣🤣
it is very sad that leaders can flout the law which appears trivial to the invidual s .
Anyway his win would not be long as he would soon be charged by MACC for illegal money laundering during BN’s rule. Need to find out how he manage to save RM10,000 and through what means?
