Tahniah rakyat Malaysia, tetapi reformasi pelantikan GLC belum selesai! (Malay/English)

[ENGLISH VERSION BELOW] Gabungan Pilihan Raya Bersih dan Adil (Bersih 2.0) mengucapkan tahniah kepada semua rakyat Malaysia di atas desakan yang diberikan kepada Kerajaan Perikatan Nasional di mana Tajuddin rahman telah dipecat daripada jawatan pengerusi bukan eksekutif Prasarana Malaysia Berhad oleh Menteri Kewangan (Diperbadankan) dengan serta-merta.

Ini merupakan satu kemenangan rakyat yang penting. Namun, masalah seperti kes Tajuddin Rahman tidak akan berhenti sekiranya tiada reformasi institusi ke atas proses pelantikan jawatan pengerusi dan ahli lembaga pengarah syarikat berkaitan kerajaan (GLC) untuk memastikan calon yang benar-benar berintegriti dan berkelayakan dilantik.

Desakan rakyat perlu diteruskan agar pelantikan jawatan syarikat berkaitan kerajaan berdasarkan kepada meritokrasi dan integriti calon, serta amalan melantik ahli parlimen atau ahli dewan undangan negeri untuk memegang jawatan dalam syarikat berkaitan kerajaan dihentikan sama sekali.

Ini amat penting demi mencegah wabak korupsi, kronisme serta politik naungan menular di dalam pentadbiran syarikat berkaitan kerajaan dan mengorbankan kepentingan rakyat.

Menteri Kewangan (Diperbadankan) perlu melantik pengerusi Prasarana yang baharu berdasarkan panduan yang sememangnya digariskan oleh pihak Kementerian Kewangan sendiri sejak dari tahun 2014 lagi. Antara garis panduan tersebut adalah:

Satu jawatankuasa penamaan calon yang bebas untuk menerima cadangan-cadangan calon dan menyenarai-pendekkan calon-calon untuk pertimbangan lembaga pengarah Prasarana dan disahihkan oleh Menteri Kewangan (Diperbadankan)

Individu yang dilantik sebagai ahli lembaga pengarah harus mempunyai kelayakan pendidikan dan professional seperti berkepakaran dan berpengalaman dalam perniagaan, kewangan, undang-undang, perakaunan, pengurusan dan kemahiran lain yang berkaitan syarikat tersebut.

Garis panduan ini nampaknya tidak dipatuhi oleh Senator Tengku Zafrul Aziz di dalam pelantikan Tajuddin Rahman sebelum ini.

Namun demikian, Tengku Zafrul masih berpeluang memperbaiki keadaan ini dengan melantik pengerusi yang berkelayakan, berkepakaran dan berpengalaman dalam pengurusan berkaitan dengan urusan Prasarana. Tengku Zafrul tidak wajar sama sekali mengulangi kesilapan beliau sebelum ini dengan melantik ahli politik yang lain untuk mengepalai syarikat berkaitan kerajaan di bawah kelolaan beliau.

Bersih 2.0 juga menggesa kerajaan PN untuk meneliti semula semua kedudukan ahli-ahli parlimen yang dilantik mengepalai syarikat berkaitan kerajaan, syarikat berkaitan pelaburan kerajaan dan badan berkanun yang komersial.

Amalan ini perlu dihentikan dengan segera, seperti yang termaktub dalam polisi dan prosedur pencalonan dan pemilihan lembaga pengarah FGV Holdings Berhad, anak syarikat kepada Felda yang melarang mana-mana ahli politik yang aktif dilantik sebagai ahli lembaga pengarah.

Ahli parlimen yang menjawat sebagai pengarah atau pengerusi syarikat perlu diganti serta merta dengan calon yang berintegriti dan berkelayakan melalui proses yang telus, adil dan berakauntabiliti daripada terus membazirkan sumber negara membayar gaji mereka.

Bersih 2.0 sekali lagi menyeru kerajaan untuk menggubal satu akta syarikat berkaitan kerajaan bagi mereformasikan proses pelantikan pengarah atau pengerusi syarikat berkaitan kerajaan dan badan-badan berkanun. Reformasi ini penting agar individu yang dilantik tidak membawa kepentingan peribadi atau kepentingan parti lain melainkan hanya untuk kesejahteraan rakyat terbanyak.

Penamaan calon-calon untuk jawatan syarikat berkaitan kerajaan dan badan-badan berkanun yang berkaitan dengan komersial perlu juga disemak-selia oleh jawatankuasa pilihan khas parlimen untuk memastikan semua garis panduan, kriteria dan syarat proses pelantikan dipenuhi dan calon yang benar-benar berkelayakan dilantik. 

Kami juga mengesa agar Tajuddin Rahman tidak lagi dilantik untuk sebarang jawatan syarikat berkaitan kerajaan atau badan-badan berkanun yang lain. – Bersih 2.0

Congratulations, all Malaysians, but the fight to reform GLC appointments is not done yet!

The Coalition for Clean and Fair Elections (Bersih 2.0) congratulates all Malaysians on their pressure towards the Perikatan Nasional government that resulted in the sacking of Tajuddin Rahman as non-executive chairman of Prasarana Malaysia Berhad by the Minister of Finance (Incorporated) (MoF Inc) immediately.

This is an important victory for the people. However, problems such as the case of Tajuddin will not stop if there is no institutional reform of the process of appointing the chairman and board of directors of government-linked companies (GLCs) to ensure that candidates with true integrity and qualifications are appointed.

The people’s demand must continue so that appointments to posts in government-linked companies posts are based on meritocracy and the integrity of candidates and so that the practice of appointing an MP or state assembly member to positions in government-linked companies is stopped altogether.

This is paramount to prevent the epidemic of corruption, cronyism and patronage politics from infecting the administration of these companies and sacrificing the people’s interest.

The MoF Inc needs to appoint a new Prasarana chairman based on the guidelines outlined by the MoF itself since 2014.

Among the guidelines are:

  • An independent nomination committee to be established by the Prasarana board to receive candidate nominations and shortlist candidates for consideration by the board and endorsement by MOF Inc
  • Individuals appointed to the board of directors must have educational and professional qualifications such as expertise and experience in business, finance, law, accounting, management and other skills related to the company

Finance Minister Tengku Zafrul Aziz does not seem to have complied with these guidelines in the previous appointment of Tajuddin Rahman.

Nevertheless, Tengku Zafrul still has a chance to improve this situation by appointing a Prasarana chairman who is qualified, skilled and experienced in Prasarana-related management. Tengku Zafrul should not repeat his mistake by appointing other politicians to head government-linked companies under his supervision.

Bersih 2.0 also urges the PN government to re-examine all positions of MPs appointed to head government-linked companies, government-linked investment companies and commercial statutory bodies. This practice should be stopped immediately, as stipulated in the nomination and board election policy and procedures of FGV Holdings Berhad, a subsidiary of Felda, which prohibits any active politician from being appointed as a board member.

Members of Parliament who serve as directors or chairpersons of government-linked companies should be replaced immediately with candidates of integrity and qualifications through a transparent, fair and accountable process rather than continuing to waste public resources to pay their salaries.

Bersih 2.0 reiterates our call for the government to enact a government-linked companies act to reform the process of appointing directors or chairpersons of government-linked companies and commercially related statutory bodies. This reform is crucial so that the appointed individuals will not bring in personal or party interests but act in the public interest.

The nomination of candidates for posts in government-linked companies and commercially related statutory bodies should also be reviewed by parliamentary select committees to ensure all guidelines, criteria and conditions of the appointment process are met and truly qualified candidates are appointed.

We also urge that Tajuddin Rahman no longer be appointed to any government-linked company positions or other statutory bodies. – Bersih 2.0
