Pembatalan ordinan-ordinan darurat perlu penjelasan segera daripada kerajaan (Malay/English)

[ENGLISH VERSION BELOW] Kami, selaku kumpulan masyarakat madani yang menandatangani kenyataan ini, memerhati dengan dekat perkembangan persidangan Mesyuarat Khas Dewan Rakyat yang bermula pada 26 Julai.

Kami mengambil maklum jawapan lisan yang dikemukakan Menteri di Jabatan Perdana Menteri (Parlimen dan Undang-undang), Takiyuddin Hassan bahawa Proklamasi Darurat 2021 akan terus berkuatkuasa sehingga 1 Ogos tetapi semua ordinan darurat 2021 telah dibatalkan oleh kerajaan.

Kami menyambut baik pengumuman luar jangka bahawa kerajaan telah membatalkan semua ordinan darurat dan keputusan itu berkuatkuasa pada 21 Julai 2021. Namun, pengumuman ini telah menimbulkan pelbagai persoalan

Pertama, mengapa keputusan pembatalan semua Ordinan Darurat hanya diumumkan di Parlimen [pada 27 Julai] dan tidak secara rasmi kepada awam pada 21 Julai yang lepas memandangkan keputusan ini amat penting dan mempengaruhi semua rakyat.

Kedua, kerajaan juga perlu menjelaskan sama ada Perdana Menteri telah memberi nasihat secara rasmi kepada Yang di-Pertuan Agong untuk membatalkan semua ordinan darurat tersebut. Jikalau nasihat tersebut telah diberikan oleh perdana menteri kepada Agong dan Agong telah memperkenankan nasihat tersebut, kenapa tidak terdapat kenyataan umum daripada pihak Istana Negara?

Ketiga, sehingga hari ini, didapati keputusan kerajaan ini tidak dijumpai dalam warta kerajaan. Kerajaan Perikatan Nasional perlu memberikan penjelasan mengapa keputusan pembatalan ordinan-ordinan darurat belum lagi diwartakan jika penguatkuasaan pembatalan ordinan-ordinan darurat telah bermula sejak 21 Julai lepas.

Keempat, kerajaan juga perlu memberikan penjelasan kepada rakyat apakah yang akan terjadi kepada segala tindakan, termasuk denda-denda dan kompaun yang telah dikenakan oleh pihak berkuasa dalam tempoh 21 Julai sehingga 27 Julai 2021 yang berdasarkan ordinan-ordinan tersebut kerana ordinan-ordinan darurat lagi tidak berkuatkuasa.

Kami meminta perdana menteri untuk segera menjawab pertanyaan-pertanyaan yang bersangkutan bagi mengelakkan krisis perlembagaan yang lain. Kelewatan memberikan penjelasan umum pada sidang Parlimen Isnin adalah tidak dapat diterima.

Kenyataan ini adalah inisiatif Komuniti Perintis untuk Parlimen Profesional, sebuah jaringan individu yang aktif dalam kumpulan masyarakat madani, badan pemikir dan akademia yang memperjuangkan sebuah Parlimen yang profesional bagi mewujudkan persaingan dasar yang sihat antara pelbagai parti.

Revocation of emergency ordinances needs immediate clarification from government

We, the undersigned civil society groups, closely observed the progress of the special meeting of Dewan Rakyat which began on 26 July.

We take note of the oral reply presented by the minister in the Prime Minister’s Department (for Parliament and law), Takiyuddin Hassan that the 2021 Emergency Proclamation will continue in force until 1 August but all the emergency ordinances for 2021 have been revoked by the government.

We welcome the unexpected announcement that the government has revoked all the emergency ordinances for 2021 and that the decision takes effect on 21 July 2021. However, this announcement has raised various questions.

First, why was the decision to revoke all the emergency ordinances only announced in Parliament on 27 July and not officially to the public on 21 July when this decision is of utmost importance and affects all the people.

Second, the government also needs to clarify whether the prime minister has formally advised the Yang di-Pertuan Agong to revoke all the emergency ordinances. If the advice was given by the prime minister to the Agong and the Agong has consented to the advice, why was there no public statement from the national palace?

Third, until today, this government decision was not found in the government gazette. The Perikatan Nasional government needs to provide an explanation as to why the decision to revoke the emergency ordinances has not yet been gazetted if the enforcement of the revocation of the emergency ordinances started on 21 July.

Fourth, the government must also provide an explanation to the people about what will happen to all actions, including fines and compounds imposed by the authorities during the period from 21 July to 27 July that were based on those ordinances because the emergency ordinances 2021 should not be in force anymore.

We call on the prime minister to immediately answer these pertinent questions to avoid another constitutional crisis. Delay in providing a public explanation to Monday’s Parliament sitting is unacceptable.
