[ENGLISH VERSION BELOW] Gabungan Pilihan Raya Bersih dan Adil (Bersih) dan the Centre For Independent Journalism (CIJ) telah mengadakan pertemuan bersama Menteri Komunikasi Fahmi Fadzil dan timbalan menteri, Teo Nie Ching, di pejabat menteri baru-baru ini.

Pertemuan yang turut dihadiri pegawai utama dari Suruhanjaya Komunikasi dan Multimedia (SKMM) menyentuh isu utama berkaitan cadangan pelesenan platform sosial media dan pesanan internet oleh kerajaan.

Bersih dan CIJ nyatakan kebimbangan tentang perkembangan kebebasan media hari ini khususnya melibatkan isu pelesenan ini, lebih-lebih lagi apabila agenda reformasi masih perlahan dari pelaksanaan kerajaan “Madani”.

Namun kita tidak nafikan peranan kerajaan untuk memastikan platform media sosial dan pesanan internet bertanggungjawab dalam sebarang isu yang menjejaskan kesejahteraan hidup rakyat serta menyalahi prinsip hak asasi manusia.

Maka, kami nyatakan pendirian kami seperti berikut –

  • Kerajaan perlu pastikan pembinaan code of conduct dibuat secara inklusif, telus dan bertepatan dengan prinsip-prinsip kebebasan bersuara berasaskan standard antarabangsa di mana sebarang sekatan bersuara harus memenuhi prinsip legitimacy (pengabsahan), necessity (keperluan) dan proportionality (setimpal)
  • Pastikan badan yang melaksanakan pemantauan kepatuhan code of conduct terdiri daripada pelbagai pihak berkepentingan supaya ada ketulusan dalam sebarang keputusan yang dibuat tanpa campurtangan politik
  • Pada masa yang sama, segerakan penubuhan majlis media atau sebarang platform yang bertindak sebagai kata putus dalam menentukan sesuatu kandungan dalam media sosial itu sama ada baik atau bercanggah dengan code of conduct dan boleh dikenakan tindakan
  • Sebarang tindakan yang dilakukan tidak harus dibayangi motif politik bagi menekan mana-mana musuh politik sebaliknya fokus kepada isu keselamatan data, buli siber, penipuan dalam talian child sexual abuse materials dan sebagainya
  • Pihak kami juga menuntut komitmen kerajaan untuk memansuhkan peruntukan-peruntukan yang bersifat drakonian seperti Seksyen 8A Akta Mesin Cetak dan Penerbitan, Seksyen 211 dan 233 Akta Komunikasi dan Multimedia, Seksyen 505 Kanun Keseksaan dan Akta Hasutan

NGOs meet Fahmi to state position on media freedom developments

The Coalition for Clean and Fair Elections (Bersih) and the Centre for Independent Journalism (CIJ) held a meeting with Communications Minister Fahmi Fadzil and his deputy, Teo Nie Ching, at the minister’s office yesterday.

The meeting, which was also attended by key officials from the Malaysian Communications and Multimedia Commission (MCMC), discussed key issues related to the government’s proposal to license social media and internet messaging platforms.

Bersih and the CIJ expressed concern about the current state of media freedom, particularly regarding this licensing issue, especially given the slow progress of reforms under the “Madani” [civil and compassionate] government.

However, we do not deny the government’s role in ensuring that social media and internet messaging platforms are held accountable for any issues that affect public wellbeing and violate human rights principles.

Therefore, we stated our position as follows:

  • The government must ensure that the development of the code of conduct is done inclusively and transparently, and in accordance with the principles of freedom of expression based on international standards, where any restrictions on expression must meet the principles of legitimacy, necessity and proportionality
  • Ensure that the body responsible for monitoring compliance with the code of conduct is a multi-stakeholder entity to guarantee transparency in decision-making without political interference
  • At the same time, expedite the establishment of a media council or any platform that acts as a final arbiter in determining whether content on social media is appropriate or violates standards and may be subject to action
  • Any actions taken should not be driven by political motives to suppress political opponents; rather they should focus on issues like data security, cyber-bullying, online fraud and child sexual abuse materials
  • We also call on the government to commit to abolishing draconian provisions such as Section 8A of the Printing Presses and Publications Act, Sections 211 and 233 of the Communications and Multimedia Act, Section 505 of the Penal Code and the Sedition Act
