Polis patut siasat, tangkap, dakwa Jamal Md Yunus dan mereka yang bertindak ganas

Kami, pertubuhan-pertubuhan masyarakat madani yang berikut, menyeru Ketua Polis Negara untuk segera menyiasat, menangkap dan mendakwa Jamal Md Yunus, ketua bahagian Umno Sungai Besar dan pengikut-pengikutnya atas kesalahan ugutan jenayah dan keganasan terhadap peserta-peserta konvoi Bersih 5 pada 1 Oktober 2016 supaya kedaulatan undang-undang ditegakkan.

Dalam kejadian pertama, Bersih 2.0 telah melaporkan bahawa penyokong baju merah telah mengekori konvoi Bersih 5 di Lumut, merampas bendera Bersih dari kenderaan konvoi, menendang kereta, dan menumbuk cermin sisi kenderaan.

Dalam kejadian kedua, apabila konvoi Bersih 5 sampai di Teluk Intan, mereka telah dihalang oleh penyokong baju merah yang berlagak seperti samseng dan diketuai oleh Jamal Md Yunus. Ahli jawatankuasa pemandu Bersih Jay Jay Denis yang berada di tempat kejadian berkata bahawa Jamal cuba merampas bendera yang dibawa oleh tiga peserta Bersih dan dia juga telah menumbuk seorang lelaki yang berdiri di tengah. Beberapa peserta Bersih juga telah tercedera dalam kekecohan yang berlaku selepas itu.

Kami mengecam perbuatan samseng dan ganas yang dilakukan oleh Jamal Md Yunus dan penyokongnya. Mereka berlagak seperti samseng yang tidak memperdulikan undang-undang dan seakan-akan pihak polis tidak dapat berbuat apa-apa terhadap mereka.

Kami ingin merakamkan penghargaan dan rasa terima kasih kami kepada pihak polis di tempat lain yang telah melakukan tugas mereka secara professional dengan mengekalkan keamanan dan memberi kerjasama dengan konvoi Bersih sehingga program berjalan tanpa sebarang masalah.

Walau bagaimanapun, kami kecewa dengan polis di Lumut dan Teluk Intan yang tidak berbuat apa-apa untuk menghalang tindakan ganas penyokong-penyokong baju merah di kedua-dua bandar walaupun mereka berada di tempat kejadian dan menjadi saksi kepada kedua-dua kejadian ini. Mengapa polis tidak menangkap samseng berkenaan dengan serta-merta?

Kami terkejut kerana Jamal Md Yunus masih boleh bergerak bebas di negara ini setelah melakukan tindakan ganas yang disaksikan oleh ramai orang dan video rakaman juga diviralkan di media sosial. Ke mana perginya ketua polis negara yang begitu ghairah menghantar ”tweet” arahan kepada pegawainya untuk melakukan tangkapan apabila rakyat umum sekadar membuat komen terhadap isu kepentingan awam secara aman dalam media sosial?

Jamal Md Yunus dan penyokongnya berhak untuk berpegang kepada pendapat mereka dan bebas untuk menyuarakan bantahan mereka kepada konvoi Bersih 5 kerana ini adalah hak yang termaktub dalam Perlembagaan Persekutuan.

Walau bagaimanapun, mereka hanya boleh melakukannya secara aman dan bukannya menggunakan keganasan. Jamal Md Yunus jelas telah melanggar undang-undang dengan menyerang orang lain secara fizikal dan dia sepatutnya telah ditangkap sekarang.

Jikalau tiada dakwaan jenayah dikenakan terhadap Jamal Md Yunus dan penyokong-penyokongnya yang melakukan keganasan, ini sudah tentu akan menjadi satu tanda tanya sama ada tindakan mereka itu mendapat sokongan politik dari pihak berkuasa tertentu.

Kegagalan ketua polis negara untuk menangkap dan mendakwa Jamal Md Yunus dan pengikut-pengikutnya yang melakukan ugutan dan keganasan, malangnya akan menunjukkan bahawa Malaysia sekarang diperintah oleh samseng dan bukannya lagi oleh undang-undang.

Police must investigate, arrest and charge Jamal Md Yunus and other perpetrators of violence

We, the undersigned organisations, call on the inspector general of police to immediately investigate, arrest and charge Sungai Besar Umno division chief, Jamal Md Yunus and other perpetrators of violence for criminal intimidation and violence against the Bersih 5 convoy participants on 1 October 2016 to uphold the rule of law in this country.

In the first incident, the red shirt supporters were reported by Bersih 2.0 as having tailed the Bersih 5 convoy in Lumut, pulling flags from convoy vehicles, kicking the cars and punching their vehincles’ side mirrors.

In the second incident, when the Bersih 5 convoy reaching Teluk Intan, they were blocked by Red Shirt thugs led by Jamal Md Yunus. Bersih steering committee member Jay Jay Denis, who was there, said that Jamal tried to yank the banner being carried by three Bersih participants and he landed a blow on the guy in the centre. A few Bersih participants were hurt during the scuffle that ensued.

We strongly condemn such thuggish and violent actions by Jamal Md Yunus and his supporters. They behaved like gangsters as if they were above the law, and even the police could not touch them.

We wish to record our gratitude and appreciation to the police in other areas who have done their job professionally by maintaining order and facilitating the peaceful convoy to proceed without any problem.

We are, however, disappointed with the police in Lumut and Teluk Intan who did nothing to prevent the violent acts of the Red Shirts from taking place in those two cities despite being present at the location and witnessing the two incidents. Why didn’t the police present apprehend the thugs on the spot?

We are shocked that Jamal Md Yunus and other perpetrators of violence are still able to walk free in the country after such violent aggression in broad daylight with so many witnesses and video recordings going viral online. Where is the inspector general of police who immediately tweets orders to his men to make an arrest when someone merely peacefully posts an opinion on issues of public interest online?

Jamal Md Yunus and his supporters are entitled to their opinion and may express disagreement with Bersih 5 convoy as this is their constitutional right. However, they can only do so in a peaceful manner and not resort to violence. Jamal Md Yunus is clearly in breach of the law by harming others physically and he should have been arrested by now.

One must question if Jamal Md Yunus is getting political endorsement for such actions from the power that be if no action or criminal charges are pressed on him.

The failure of the inspector general of police to arrest and prosecute Jamal Md Yunus will unfortunately imply that Malaysia is now ruled by thugs instead of ruled by law.
