Suruhanjaya melahirkan harapan bahawa perhimpunan aman pada masa hadapan, pada bila-bila masa diadakan, akan dijalankan dengan cara yang sama, ujar Hasmy Agam. (English version below)

Selaras dengan mandat statutorinya, Suruhanjaya Hak Asasi Manusia Malaysia (Suruhanjaya) telah memantau perhimpunan aman Bersih 4 dan secara keseluruhannya, ingin memuji pihak berkuasa, khususnya Polis Diraja Malaysia (PDRM) kerana bersikap profesional dalam memudahcara perhimpunan tersebut; serta penganjur dan para peserta untuk perhimpunan yang berjaya dijalankan dalam susasana harmoni di Kuala Lumpur, Kuching dan Kota Kinabalu pada 29-30 Ogos 2015.

Suruhanjaya berpandangan ini adalah bukti bahawa perhimpunan seumpama ini boleh diadakan tanpa kejadian yang tidak diingini jika ada perancangan dan kerjasama di antara semua pihak yang berkenaan.

Namun begitu Suruhanjaya masih bimbang mengenai perintah larangan yang mengharamkan sebarang pakaian berwarna kuning yang mengandungi perkataan “Bersih 4” dan berharap agar pihak berkuasa, sebelum sesebuah perhimpunan diadakan, tidak akan mengklasifikasikan ia sebagai jenayah jika seseorang ingin menghadiri atau menganjurkan sesebuah perhimpunan aman.

Dalam masa yang sama, Suruhanjaya menyeru pihak polis untuk tidak meneruskan penangkapan ke atas pihak penganjur seperti yang dinyatakan sebelum ini, kerana tindakan tersebut hanya akan mencemarkan imej positif yang telah diwujudkan dalam dan luar negara berikutan perhimpunan aman tersebut.

Kesimpulannya, Suruhanjaya ingin mengucapkan tahniah kepada semua pihak yang bertanggungjawab dalam menjayakan perhimpunan aman pada hujung minggu lalu dan menekankan kepentingan dialog yang inklusif dan bermakna, terutamanya antara Komander Polis yang bertanggungjawab dan pihak penganjur sebelum sesebuah perhimpunan diadakan.

Ini secara jelas menunjukkan bahawa dalam semangat keyakinan dan kepercayaan, hak kepada kebebasan berhimpun secara aman seperti yang dijamin dalam Perlembagaan Persekutuan dan Akta Perhimpunan Aman 2012, serta mematuhi Perisytiharan Hak Asasi Manusia Sejagat boleh direalisasikan.

Suhakam: Bersih 4 concluded peacefully

In accordance with its statutory mandate, the Human Rights Commission of Malaysia monitored the Bersih 4 peaceful assembly and at the outset, wishes to commend the authorities, in particular the Royal Malaysia Police (PDRM) for their professional conduct in facilitating the assemblies, as well as the organisers and participants in ensuring successful and harmonious assemblies in Kuala Lumpur, Kuching and Kota Kinabalu on 29-30 August 2015.

This in the Commission’s view is testament that such assemblies can be held without untoward incidents if there is proper planning and cooperation among all parties concerned.

The Commission nevertheless remains concerned at the move to criminalise any yellow-coloured clothing which contains the words Bersih 4 and hopes that the authorities will not prior to an assembly, seek to criminalise among others, the participation in and organisation of a peaceful assembly with a view to sanctioning or deterring those intending to participate.

In this regard, the Commission calls on the police not to proceed with the arrests of the organisers as previously indicated, as such action will only mar the positive image that has been created in the country and around the world following the peaceful conduct of the assembly.

In conclusion, the Commission wishes to congratulate all parties responsible for the peaceful assemblies over the weekend and stresses the importance of inclusive and meaningful dialogue between the local Police Commanders and the organisers prior to the assemblies, which had clearly demonstrated that in the spirit of mutual confidence and trust it was possible to uphold the right to the freedom of peaceful assembly as guaranteed by the Federal Constitution and the Peaceful Assembly Act 2012, and in compliance with the Universal Declaration of Human Rights.

The Commission expresses the hope that future peaceful assemblies, whenever held, will be conducted in the same exemplary manner as expected of a true fully-functioning democracy.
